Welcome to Amature, a platform designed to foster meaningful connections in an inclusive environment. The amature.co website and application is operated by Abiomye Industries Private Limited. The following Terms of Use, together with any documents referred to in them (collectively, these "Terms"), apply to a person who voluntarily submits information to the app (the "User" or "you" or "your") and will constitute a legal contract which you must accept to begin using the platform through our website or application ("Amature" or "we" or "us" or "our" or the "App").

Amature contains information including, but not limited to, texts, images, photographs, documents, privacy policy, videos, testimonials, logos, diagrams, reports, communications, and other content and tools, some of which may relate to or describe Amature's offerings and services (collectively "Services"). By using the Service, you consent to submit your personally identifiable information including but not limited to sensitive personal data such as your financial data if opted for our paid membership (the "Amature Premium"), to collect, process, display and use the said information to provide the Service. If you have any objection in collecting or processing your personal data, we advise you not to register with us. At any time, if you want to withdraw your consent or if you have any objection in continuous collection or storage of your personal details, it is recommended you discontinue using our Service immediately and delete your account. Amature is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000 and helps facilitate communication between individuals who opt in to use Amature's Services.

Your access and/or use of Amature or any Services indicates your acceptance of these Terms and our Privacy Policy. If you do not agree to the Terms, do not use Amature or any of its associated materials. Amature may, at any time, revise and update these Terms in its sole discretion, with or without notice. Any changes to these Terms will take effect immediately upon posting on the App and will be reflected in the effective date. Your continued access of or use of the App or any Amature materials will automatically indicate your acceptance of the modified Terms.

Eligibility, Responsibility & Site Access

To use Amature you confirm that:

• You are a natural person at least 18 years old. Corporations or other legal entities are not considered eligible and are barred from using our Services.
• You are legally qualified to enter into this binding contract with us.
• You are not prohibited by law from using our Services.
• You have not committed, been convicted of, or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence or a threat of violence, unless you have received clemency for a non-violent crime and we have determined that you are not likely to pose a threat to other Users.
• You do not have more than one account on our Services.
• You have not previously been removed from our Services by us, unless you have our express written permission to create a new account.

If at any time you cease to meet the above requirements, all authorization to access our Services will be automatically revoked, and you must immediately delete your account. In addition to that, for the safety of other Users, we retain the right to remove your access to our Services without warning.

Additionally, to be granted access, you agree to:

• Comply with these Terms, and check this page from time to time to ensure you are aware of any changes.
• Comply with all applicable laws, including without limitation, privacy laws, intellectual property laws and regulatory requirements.
• Use the latest version of the website and/or the App.
• Review and comply with the Community Guidelines, as updated from time to time.
• Take reasonable measures to protect the security of your login information.

Lastly, you agree that you will not:

• Misrepresent your identity, age, or affiliations with a person or entity.
• Use the Services in a way that damages the Services or prevents their use by other Users.
• Use our Services in a way to interfere with, disrupt or negatively affect the Amature platform, the servers, or our Services' networks.
• Use our Services for any harmful, illegal, or nefarious purpose, including using the App for money laundering or other financial crimes.
• Harass, bully, stalk, intimidate, assault, defame, harm or otherwise abuse or cause psychological harm to any person.
• Post or share content that is offensive, abusive, obscene, pornographic, violent, contains nudity, is racist, encourages illegal activity, relates to commercial activities, or constitutes spam.
• Solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other Users or disseminate another person's personal information without their permission.
• Solicit money or other items of value from another User, whether as a gift, loan, or form of compensation.
• Use another User's account.
• Use our Services in relation to fraud, a pyramid scheme, or other similar practices.
• Use our Services in relation to any political campaign financing or for the purpose of influencing any election.
• Disclose private or proprietary information that you do not have the right to disclose.
• Copy, modify, transmit, distribute, or create any derivative works from, other User or any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property accessible through our Services without our prior written consent.
• Upload viruses or other malicious code or otherwise compromise the security of our Services.
• Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of our Services.
• Use or develop any third-party applications that interact with our Services or Users without our written consent, including artificial intelligence or machine learning systems.
• Probe, scan or test the vulnerability of our Services or any system or network.
• Create a new account after we suspend or terminate your account, unless you receive our express permission to do so.
• Submit a report about a member's behavior or content that is false, misleading, or otherwise manifestly unfounded.

The license granted to you under these Terms and any authorization to access the Services will be automatically revoked in the event that you do any of the above.

User Accounts and Security

To get the best out of your Amature experience, you will be prompted to create an account (the "User Account") on the App to access the App materials and avail our Services. You agree to input accurate and up-to-date information when creating a User Account. You may not impersonate another individual when creating a User Account. You are responsible for maintaining the confidentiality and security of your account, including all of your usernames, passwords, or other credentials. You are solely responsible for all activities that occur under your User Account.

Content

While using our Services, you will have access to: (i) content that you upload or provide while using our Services ("Your Content"); (ii) content that other Users upload or provide while using our Services ("Member Content"); and (iii) content that Amature provides on and through our Services ("Our Content"). In this agreement, "content" includes, without limitation, all text, images, video, audio, or other material on our Services, including information on Users' profiles and in direct messages between Users.

While you will have access to the content on Amature, you are expressly prohibited from posting inappropriate content, including content that:

• Is illegal or encourages, promotes or incites any illegal activity.
• Is harmful to minors and the community.
• Is defamatory or libelous.
• Infringes any third party's intellectual property or privacy rights.
• Shows another person which was created or distributed without that person's consent.
• Contains language or imagery which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person.
• Is obscene, pornographic, violent or otherwise may offend human dignity.
• Is abusive, insulting or threatening, discriminatory or promotes racism, sexism, hatred or bigotry.
• Relates to commercial activities including sales, competitions and advertising.
• Involves the transmission of "junk" mail or "spam".
• Impersonates or intends to deceive or manipulate a person.
• Contains any spyware, adware, viruses, corrupt files, worm programs or other malicious code.
• In any other way violates our Community Guidelines.

Your Content

You will be allowed to upload, post, or provide information to another User via the App. You are solely responsible and liable for Your Content and you agree to indemnify, defend, release, and hold us harmless from any claims made in connection with Your Content.

You agree that you have the necessary rights and permissions to provide Your Content and that any of Your Content provided adheres to our Terms. Upon providing Your Content, you grant Amature a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display Your Content or any part thereof, subject to applicable laws and regulations, these Terms, and our Privacy Policy.

You may not display any personal contact, banking information, or other peer-to-peer payment information, whether in relation to you or any other person. If you choose to reveal any personal information about yourself to other Users, you do so at your own risk. We strongly encourage you to use caution in disclosing any personal information online.

AMATURE IS NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE LISTING POSTED ON THE APP OR THE SERVICE. AMATURE DOES NOT CONTROL, HAS NO OBLIGATION TO MONITOR, AND IS NOT RESPONSIBLE FOR WHAT USERS POST, AND IS NOT RESPONSIBLE FOR ANY OFFENSIVE, INAPPROPRIATE, OBSCENE, UNLAWFUL, OR OTHERWISE OBJECTIONABLE OR ILLEGAL CONTENT ON THE APP.

Member Content

Like you, other Users of the App will also share their content making it Member Content. Member Content belongs to the User who posted it and is stored on our servers. You do not have any rights in relation to other Users' Member Content, and you may only use other Amature Users' personal information to the extent that your use of it aligns with our purpose. You may not use other Users' information for commercial purposes, to spam, to harass, stalk or to make unlawful threats. Misusing other Users' information will lead to termination of your account with Amature.

Our Content

Any other text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, images, and other intellectual property appearing on our Services is owned, controlled or licensed by us and protected by copyright, trademark and other intellectual property law rights. All rights, title, and interest in and to Our Content remains with us at all times.

You are granted a strictly non-exclusive, limited, personal, non-transferable, revocable license to access and use Our Content, without the right to sublicense. You are not permitted to use, sell, modify, or distribute Our Content; use our name in metatags or hidden text; or create derivative works from Our Content.

Intellectual Property

All information and content posted by us on the App is property of Amature, or as applicable, its licensors or a third party. Our Content is protected by copyright, trademark and other intellectual property laws. You may not modify, copy, distribute, transmit, display, publish, sell, license, create derivative works, or otherwise use Our Content for any purpose unless expressly authorised by Amature in writing. Your use of the App or Services does not entitle you to make any unauthorised use of the App or Services, nor do you acquire any ownership rights in the App or its materials.

Privacy Policy

Your access to and/or use of the App or Services is your acknowledgement of your acceptance of the terms of our Privacy Policy, which is incorporated into these Terms in its entirety.

Updates

We may, from time to time and in our sole discretion, develop and provide updates to the App and Services, which may include upgrades, bug fixes, other corrections, and/or new features (collectively, "Updates"). Updates may also modify or delete certain features and functionality. You agree that Amature has no obligation to provide any Updates or to continue to provide or enable any particular features or functionality. You further agree that all Updates will be deemed part of the Services and subject to these Terms.

No Warranties

THE APP AND THE SERVICES ARE PROVIDED ON AN "AS-IS AND AS AVAILABLE, WITH ALL FAULTS" BASIS, AND YOUR USE IS AT YOUR OWN RISK. AMATURE DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, (A) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT; (B) AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION; OR (C) THAT THE APP OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR HARMFUL COMPONENTS. AMATURE ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANOTHER USER OR THIRD PARTY POSTS, SENDS, OR RECEIVES THROUGH OUR SERVICES, NOR FOR THE IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF ANY USERS WITH WHOM YOU MAY COMMUNICATE.

Third Party Sites

We may include on the App links that will enable you to access other internet sites not under our control. The links are provided as a convenience only and we are not responsible for the content of any third-party site. Amature does not endorse any of these sites or assume any responsibility or liability for any material, product or service accessible on such other sites. All rules, policies (including privacy policies), and terms of use of websites operated by such third parties will apply to you while on such sites.

Amature prohibits third parties from producing materials which contain links to our App without our prior written consent. Amature reserves the right to disable any such unauthorised links.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMATURE, ITS AFFILIATES, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, OR ANY OTHER INTANGIBLE LOSSES, RESULTING FROM (I) ACCESSING OR USING ANY AMATURE SERVICES; (II) INABILITY TO ACCESS OR USE THE APP OR OUR SERVICES; (III) ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION THROUGH THE INTERNET; (IV) THE CONDUCT OR CONTENT OF ANY USERS OR THIRD PARTIES ON OR THROUGH OUR SERVICES; OR (V) ANY UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

NOTWITHSTANDING THE FOREGOING, IF AMATURE SHOULD HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY FOR ANY LOSS, HARM OR DAMAGE, YOU AGREE THAT SUCH LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE LESSER OF RS. 200 OR THE FEES YOU PAID TO AMATURE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DAY THE ACT OR OMISSION OCCURRED WHICH GAVE RISE TO YOUR CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Amature, our affiliates, and their and our respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney's fees, due to, arising out of, or relating in any way to your access to or use of our Services, Your Content, your conduct toward other Users, or your breach of this agreement.

Termination and Access Restriction

You can delete your account at any time by logging into the App and going to "Settings", clicking "Delete Account", and following the instructions. However, you will need to cancel any external service purchases through your external service account (e.g., iTunes, Google Play) to avoid additional billing.

Amature reserves the right to investigate and, if appropriate, suspend or terminate your account without a refund if Amature believes that you have violated these Terms, misused our Services, or behaved in a way that Amature regards as inappropriate or unlawful, on or off our Services.

If your account is terminated by you or by us for any reason, these Terms continue and remain enforceable between you and Amature, and you will not be entitled to any refund for purchases made. Your information will be maintained and deleted in accordance with our Privacy Policy.

Purchases and Subscriptions

To enhance your Amature experience, we may offer products and services for purchase on the App ("In-App Purchase"). If you choose to make an In-App Purchase to use Amature Premium or other offerings, you acknowledge and agree that additional terms, disclosed to you at the point of purchase, may apply and are incorporated herein by reference.

If you make a purchase, you agree to pay the prices displayed to you for the Services you've selected as well as any sales or similar taxes that may be imposed on your payments, and you authorise Amature to charge the payment method you provide (the "Payment Method"). We may correct any billing errors or mistakes even if we have already requested or received payment.

You may make an In-App Purchase through a third-party platform such as the Apple App Store or Google Play Store ("Third Party Store"), or by paying with your credit card, debit card, or other supported payment method processed by a third-party processor.

Subscriptions and Auto-Renewal: We offer automatically-renewing subscriptions unless stated otherwise. Your Payment Method will continue to be periodically charged for the subscription until you cancel. To avoid charges for a new subscription period, you must cancel your subscription before the end of the then-current subscription period. Deleting your account or deleting the application from your device does not cancel your subscription.

Cancelling Subscriptions: If you purchased a subscription through a Third Party Store such as the Apple App Store or Google Play Store, you will need to access your account with that Third Party Store and follow instructions to change or cancel your subscription. If you cancel your subscription, you may use your subscription until the end of the period you last paid for, but you will not be eligible for a prorated refund, and your subscription will not be renewed when that period expires.

All charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods.

Compliance with Laws, Jurisdiction and Governing Law

If there is any dispute about or involving the App and/or the Service, by using the App, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Delhi, India only.

Any claim or dispute related to the App or under these Terms must be instituted within one (1) year after the claim arose, or be forever waived and barred.

Assignment

Amature may assign these Terms, in whole or in part, in its sole discretion. You may not assign your rights under these Terms without Amature's prior written permission. Any attempt by you to assign your rights under these Terms without Amature's permission shall be void.

Miscellaneous

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Amature as a result of these Terms or use of the App or Services. The waiver by Amature of a breach of any provision of these Terms shall not operate or be construed as a waiver of any other or subsequent breach. If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, the remaining provisions of these Terms shall remain in full force and effect.
